Scope
(1) The following General Terms and Conditions - hereinafter referred to as "GTC" - apply to the purchase of goods through the web shop www.mapbagrag.com - hereinafter referred to as "mapbagrag®" - by consumers and entrepreneurs - hereinafter referred to as "the customer".
(2) By placing an order, the customer expressly agrees to these GTC.
(3) Any terms and conditions of the customer of any kind are hereby expressly rejected by mapbagrag®.
Contracting Party and Language of the Contract
(4) The contracting parties for the purchase contract are mapbagrag® on one side and the customer on the other side.
(5) A minimum age of 18 years applies for the order. By placing the order, the customer confirms that they have already reached the age of 18.
(6) The language of the contract is German.
Conclusion of Contract and Storage of Contract
(7) The customer places the order by filling out the order form and clicking the "Buy Now" button, thereby making a binding offer to conclude a purchase contract for the ordered goods. An order can only be placed if all mandatory fields marked with "*" in the order form are filled out. If information is missing, the customer receives an error message. Before the final completion of the order, the customer has the opportunity to correct their order. Supporting detailed information is provided directly during the ordering process.
(8) As soon as the ordering process is completed and the order has been received by mapbagrag®, the customer will be notified both by an info window "Your order has been received" and via the email address provided by them (confirmation of receipt). This confirmation of receipt does not yet constitute acceptance of the customer's offer by mapbagrag®. The customer is bound to their order for 14 days from the date it is received by mapbagrag®.
(9) A contract is only concluded after acceptance of the customer's offer by mapbagrag® within the aforementioned 14-day period. The customer will also be notified of the acceptance via the email address provided (order confirmation).
(10) The contract is stored by mapbagrag® through the storage of the email containing the confirmation of receipt to the customer. This email is not accessible to the customer via the webshop. If the customer wishes to print or save the contract text after placing the order via the webshop, they can proceed as follows: After completing the ordering process, a corresponding confirmation appears in the browser, which can be saved and printed directly by the customer in the browser.
Prices, Payment Terms, and Retention of Title
(11) All prices are total prices. They include all taxes including value-added tax and duties, but exclude shipping costs and processing fees. The amount of shipping costs and processing fees is separately indicated in the respective offers.
(12) Payment must be made by bank transfer to the accounts at bunq. Customers from Austria - IBAN: NL37BUNQ2034716795 Customers from the EU or third countries - IBAN: NL32BUNQ2036030459 Credit cards and PayPal are accepted.
(13) Unless otherwise agreed, the customer agrees to pay the purchase price within 14 days after receipt of the order confirmation. Delivery of the ordered goods will only occur after payment has been received by mapbagrag®.
(14) Any goods delivered to the customer before payment of the purchase price remains the property of mapbagrag® until full payment of the purchase price (retention of title).
(15) In the event of default in payment, the customer is obliged to pay default interest of 4% p.a. as well as any collection costs incurred.
Delivery Conditions
(16) The ordered goods will be delivered to the customer within the specified delivery time on the product page upon receipt of the total purchase price by mapbagrag®. mapbagrag® assumes no liability for delays in delivery by transport companies.
Right of Withdrawal (Right of Cancellation) for Consumers
(17) The customer has the right to withdraw from the concluded contract without giving reasons. The withdrawal period is 14 days from the day on which the customer or a third party designated by the customer, who is not the carrier, has taken possession of the ordered goods. (18) To exercise the right of withdrawal, the customer must inform Florian Hazmuka & Co. plusminus design® Puchstraße 17, 8020 Graz, info@mapbagrag.com (e.g., by sending a letter by post or via email) of their decision to withdraw from the purchase contract.
(19) To meet the withdrawal deadline, it is sufficient for the customer to send the notification of the exercise of the right of withdrawal before the withdrawal period expires.
(20) In the event of withdrawal, mapbagrag® will reimburse the customer for all payments made by the customer to mapbagrag®, including shipping costs and processing fees, without delay and no later than 14 days from the day the notification of withdrawal was received by mapbagrag®. For this reimbursement, mapbagrag® will use the same payment method that the customer used for the original transaction unless expressly agreed otherwise with the customer; in no case will the customer be charged any fees for this reimbursement. mapbagrag® may withhold the reimbursement until the customer has returned the goods or until the customer has provided proof that they have returned the goods, whichever is the earlier event.
(21) The customer must return the goods without delay and in any case no later than 14 days from the day the customer informed mapbagrag® of the withdrawal from the contract. The deadline is met if the goods are dispatched before the expiry of this period.
(22) The direct costs of returning the goods are to be borne by the customer.
(23) The customer is only liable for any diminished value of the goods if this diminished value is due to handling of the goods that is not necessary to check the nature, characteristics, and functioning of the goods.
(24) The products "flip", "cover", and "cover plus", as well as all products in the category "Design Your mapbag", are excluded from the right of withdrawal. These products are not standard products and are specifically tailored or customized for the customer.
Data Protection
(25) The customer agrees that the data provided by them during the ordering process will be processed for the purpose of processing the order and payment transactions as well as for advertising purposes by mapbagrag® and to fulfill legal requirements (automated). This data will not be shared with third parties.
Consent to Receive Promotional Emails
(26) The customer agrees to receive messages from mapbagrag® about its products, current offers, and other information from mapbagrag® via promotional email, especially newsletters.
(27) The customer can revoke their consent to receive such emails at any time by clicking the corresponding link "Unsubscribe" included in each promotional email from mapbagrag®.
